If your insurer’s value feels low—on a total loss or after repairs—the appraisal clause in your policy allows you trigger an independent valuation. In Oregon, state law mandates your appraisal costs are reimbursed by your carrier if the final settlement value is higher (ORS 742.466), meaning our work is often free to you. Here’s how it works, when to use it, and what to expect.

Oregon Appraisal Clause: When It’s Free & How to Use It

When to Invoke It
· You disagree in writing with the insurer’s valuation (ACV) settlement offer (Usually presented as a valuation report from CCC or Mitchell)
· Negotiation has stalled and you want an independent review with a binding process.
What It Costs (Often Covered in Oregon)
· Most policies say each side pays its own appraiser and splits an umpire if needed, however state law takes precedent and in Oregon ORS 742.466 means most circumstances mandate the insurance company pays for your appraisal fees as well as theirs.
· In practice, many Oregon clients pay $0 out of pocket most of the time because Oregon law requires your comprehensive/collision policy covers their appraisal fee. We’ll confirm this when we review your declarations page.
Step‑by‑Step Process
1. Request a copy of your policy (or declarations page) and confirm the appraisal clause language.
2. Send a short notice invoking the clause (template below).
3. Each side selects an appraiser. We represent you and compile the evidence: photos, build data, comparable sales, condition notes, repair documents, and stigma sources (Carfax, trade‑in impact, etc.).
4. We will Reconcile or select an umpire in coordination with the opposing appraiser. If values differ, a neutral umpire reviews both and issues a binding decision.

What to expect in the process
Timeline
Most cases resolve 1–2 weeks after formal invocation, depending on records and insurer responsiveness.
